This Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondent to correct the petitioner's date of birth from the incorrect date of 23.02.1976 to the actual date of 30.03.1976 in the petitioner's passport bearing No.U0445733, valid till 19.01.2030, so as to avoid further complications and also to issue a fresh passport after considering the petitioner's representation dated 04.06.2025.
2. The petitioner was earlier issued with a passport in the year 2006, which was valid up to the year 2016. Subsequently, the passport was renewed and reissued by the Indian Embassy in Dubai for a period of 10 years, from 20.01.2020 to 19.01.2030.
3. The case of the petitioner is that the petitioner had originally furnished the date of birth as 23.02.1976. It is submitted that the petitioner has recently obtained a Birth Certificate from the Commissioner of Kadayanallur Municipality under the provisions of the Registration of Births and Deaths Act, 1969, and the Tamil Nadu Registration of Births Page No. 2 of 5
and Deaths Rules, 2000, wherein the correct date of birth of the petitioner has been given as 30.03.1976. Therefore, the petitioner has sent a representation dated 04.06.2025, for making necessary changes in the passport issued to the petitioner.
4. On a query regarding the education of the petitioner, it is informed that the petitioner is semi-literate, having studied up to the fourth standard.
5. Considering the fact that a Birth Certificate has been issued to the petitioner, recording the date of birth as 30.03.1976, I am of the view that there can be no impediment in directing the respondent to consider the petitioner's representation dated 04.06.2025 for altering the date of birth in the petitioner's passport from 23.02.1976 to 30.03.1976.
6. The respondent is, therefore, directed to consider the aforesaid representation after examining the records, and pass appropriate orders on merits, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order. Page No. 3 of 5
7. With the above observations, this Writ Petition is disposed of. No costs.
