ORDER
The present writ petition is filed for a writ of certiorarified mandamus to quash the Impugned Refusal Check Slip No. RFL/Thevaram/4/2023 dated 28.03.2023 and consequently, direct the Respondent No.3 to restore the registered property that were unilaterally strike out in page no.5 & 6 including deletion of item no.5, 6 and 7 in page no.7 of the sale deed registered as Doc. no.2362/2017 dated 31.08.2017.
2. The contention of the petitioner is that Survey No.3/6B and 3/5B2 in Pottipuram village, Uthamapalayam Taluk, Theni District belongs to the petitioner. However, the impugned Refusal Check Slip states that the land belongs to M/s.Sterling Tree Magnum India Limited. 2/6
3. The respondents have relied upon the interim order granted in the litigation in C.A.No.236 of 2018 and C.P.No.73 of 2000. But the contention of the petitioner is that the said survey numbers does not belongs to M/s.Sterling Tree Magnum India Limited. Ofcourse, the land is an adjacent land to the land belonging to the said company to which the petitioner is relying to his documents and if an opportunity is granted he would substantiate the same.
4. Therefore, the Impugned Refusal Check Slip No.
RFL/Thevaram/4/2023 dated 28.03.2023 is quashed. The petitioner is directed to submit all his documents before the respondents to claim title to the subject property. On such submissions being made, the respondents shall peruse documents pending litigation in C.A.No.236 of 2018 and C.P.No.73 of 2000, conduct enquiry and thereafter, pass appropriate orders in accordance with law. It is made clear that the petitioner may also make a submission regarding the unilaterally strike out in page no.5 & 6 including deletion of item no.5, 6 and 7 in page no.7 of the sale deed registered as Doc. no.2362/2017 dated 31.08.2017.
