ORDER

This Writ of Mandamus has been filed for a direction to the respondent to disburse all the petitioner's retirement benefits, commutation of pension, outstanding gratuity and all other monetary benefits applicable with interest within the period that may stipulated by this Court, by considering his representation dated 04.10.2016.

2.The petitioner worked as a Section Officer and retired on attaining the age of superannuation on 27.08.2014. Even though no disciplinary proceedings are pending against the petitioner, yet the terminal benefits of the petitioner is not disbursed for reasons best known to the respondent and not made known to the petitioner.

In the proceedings of the respondent dated 28.02.2015, it has been informed to the petitioner that his retirement benefits have been stopped on account of audit objection. The petitioner is not put on notice regarding the nature of objection raised in the audit. In any event, the https://hcservices.ecourts.gov.in/hcservices/

petitioner is not concerned with either the audit objection or inter departmental proceedings. So stating, the petitioner submitted a representation to the respondent on 07.09.2016 followed by another representation dated 04.10.2016. As there was no response to the said representations, this writ petition has been filed.

3.The learned Special Government Pleader appearing for the respondents would submit that the representations of the petitioner would be considered and appropriate orders will be passed on merits.

4.Recording the submission made by the learned Special Government Pleader, this Writ Petition is disposed of directing the respondent to consider the representations of the petitioner dated 07.09.2016 and 04.10.2016 respectively, and to pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. No costs.
