PRAYER :- For Bail in Crime No.11 of 2023 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/ sole accused herein, who was arrested on 21.05.2023 for the alleged offence under Sections 354(C), 417, 469 of IPC r/w. Section 67 of IT Act, in Crime No.11 of 2023 on the file of the respondent Police, seek bail.

2. The case of the prosecution is that the accused had uploaded the private video of the defacto complainant in the social media, when the same was asked by the defacto complainant, the petitioner gave elusive answer. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is innocent person and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution.

4.The learned Additional Public Prosecutor submitted that the earlier bail application that was filed by this petitioner was dismissed in Crl.O.P(MD) No.10831 of 2023, dated 19.06.2023 on the https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.12100 of 2023 ground that the petitioner has committed a very serious and heinous offence as against the victim girl. Further he would submit that so far five witnesses have been examined and the mobile phone, through which, the videograph taken has been sent for chemical analysis.

5. Considering the fact that there is no change of circumstances and serious allegation made against the petitioner, this Court is not inclined to grant bail to the petitioner.
