ORDER
This writ petition has been filed for the following relief : "directing the Respondents No.1 to 6 to take appropriate steps to remove the piece of obstruction through way to ran the
vehicles from Survey No.358/3, to the Petitioner's land comprised in Survey Nos.304/1, 200/3, 200/5 and 200/6 to an extent of 1.23.50 Hectares - 3 Ares 05 Cents in Patta No.696 of Old Kannivadi village, Dharumathupatty post, Dindigul West Taluk, Dindigul District, based on the petitioner's representation dated 09.05.2022, 28.05.2022."
2. The case of the petitioner is that he and his family own ancestral agricultural lands in Survey Nos.304/1, 200/3, 200/5 and 200/6 measuring 1.23.50 hectares in Patta No.696. There is Government Poramboke Panchayat Road running from Dharumathupatti to Kandasamypuram through Survey No.358/3 and joining the Dindigul Main Road. Another Government pathway from Survey No.358/3 leads to Survey No.304/2 and thereafter to Karisalpatti Main Road. Although the Revenue "A" Register shows Survey No.358/3 as a cart track, now the same is developed into a Thar road. The petitioner, neighbouring landowners, and villagers regularly use this public road and pathway for agricultural activities and transport.
3. The petitioner would further state that Village Karuppanasamy Temple is situated in Survey No.358/3 (Poramboke land) under a Neem tree. In 2017, the 7th respondent, who is the head of the hamlet, collected funds from the public and constructed a small temple measuring about 450 sq.ft. In March 2022, the 7th respondent further encroached upon the Poramboke land in Survey No.358/3 by putting up additional construction, thereby blocking the pathway in Survey No.304/2. The petitioner submitted several representations to respondents 1 to 5 on 07.03.2022, 28.03.2022, 09.05.2022, and 28.05.2022, all of which were acknowledged. Respondents 1 and 3 have issued directions to the 4th respondent to inspect the site and take appropriate action based on the petitioner's representations. The petitioner further submitted a detailed representation on 09.05.2022 and 28.05.2022 along with requisite documents. Despite repeated representations submitted by the petitioner, no effective action has been taken by respondents 1 to 6. Therefore, the petitioner has filed the present writ petition.
4. Heard the learned counsels on either side.
5. Considering the request of the petitioner, this Court directs the 4th respondent to survey the subject property and if any obstruction is found, the same shall be removed, within a period of two (2) months from the date of receipt of copy of this order.
6. With the above directions, this Writ Petitions stands allowed. No costs.
