For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.277 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 323, 324 and 506(2) of IPC in Crime No.277 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that on 20.06.2021, while playing carom, the petitioner and other accused have assaulted the defacto complainant, abused him in filthy language and threatened him with dire consequences. Hence, the complaint.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he is falsely implicated in this case.

4. The learned Government Advocate (Criminal Side), would submit that this is the third application for anticipatory bail. Earlier, this Court dismissed the applications filed by this petitioner in Crl.O.P.(MD).Nos.8244 and 11026 of 2021 on 10.08.2021 https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.14820 of 2021 and 13.07.2021 on the ground that the the petitioner has one previous case pending for the offence under Section 307 of IPC and caused three stab injuries at the back of the defacto complainant.

5. It appears that the application filed by the petitioner is without referring the change of circumstances to consider the case. Hence, since there is no change of circumstances and considering the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
