The writ petition has been filed for issuance of a Writ of Mandamus, to direct the third respondent to consider the petitioner's representation dated 23.09.2016.
2. According to the petitioner, her mother namely Kasiammal purchased a property by a registered sale deed dated 27.11.1978. Subsequently, the fourth respondent attempted to interfere with the peaceful possession and enjoyment of property, so she filed a suit in O.S.No.73 of 2015, against the fourth https://hcservices.ecourts.gov.in/hcservices/
respondent, before the learned District Munsif Court, Manapparai. After contest, the suit was decreed on 10.10.2011. The fourth respondent did not prefer any appeal and therefore the judgment has become final.
3. Mr.S.Gopal Manikandan, learned counsel for the petitioner would submit that after the demise of the mother, the petitioner has become the absolute owner of the property and he has been in possession and enjoyment of the same. As the fourth respondent continuously disturbed the possession of the petitioner, he gave a representation to the respondents on 23.09.2016, seeking police protection, since no action was taken, he has filed the present writ petition.
4. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 to 3.
5. Considering the limited prayer sought for in this petition and the submission of the learned counsel for the petitioner, without going to the merits of the case, the third respondent is directed to consider the representation of the petitioner, dated 23.09.2016, on merits and in accordance with law, after providing opportunities to the necessary parties, within four weeks from the date of receipt of a copy of this order.
