Prayer :- Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents 1 and 6 to issue Patta comprised Old Survey Nos. 156/1 and 168/1, and New Survey Nos. 292/10 and 293/28 situated in Narasinganpettai Village, Thiruvidaimaruthur Taluk, Thanjavur District in reference with the clarification and recommendation made by the 4th respondent to the 3rd respondent dated 15.11.2024 within a stipulated time as may be fixed by this Court.

ORDER

The petitioner herein seeks a direction to the respondents 1 and 6 to issue patta in favour of the petitioner in respect of the property comprised in old Survey Nos. 156/1 and 168/1, and new Survey Nos. 292/10 and 293/28, situate in Narasinganpettai Village, Thiruvidaimaruthur Taluk, Thanjavur District, in the light of the recommendation made by the respondents 3 and 4.

2. Heard the arguments of Mr.N.Marimuthu, learned counsel for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader, who takes notice for the respondents.

3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

4.According to the petitioner, he purchased the subject property under registered sale deed, dated 12.05.2008 from one Mohan and another. He submitted an application before the fifth respondent on 17.03.2004, seeking issuance of patta in his name. The said application was forwarded to the first respondent by Additional Collector (Revenue), Thanjavur, in his proceedings, dated 25.11.2022. Thereafter, the first respondent in his proceedings No.R3/1417020/2021 dated 30.05.2023, sought for certain clarification from the third respondent. The third respondent in his proceedings e.f.18190-2021-c(2), dated 13.06.2024 and 08.08.2024 submitted his report and further report. The first respondent in his letter No.R3/ 1417020/2021 dated 26.09.2024, sought

further details from the third respondent. He in turn in his proceedings in e.f.18190-2021-(c2), dated 15.11.2024, sought for a report from the fifth respondent. Thereafter, there is no progress in the matter. Hence, the petitioner has approached this Court.

5. The learned Additional Government Pleader appearing for the respondents would submit that the request made by the petitioner will be considered in accordance with law.

In view of the same, without expressing any opinion on the merits of the matter, the fifth respondent is directed to submit his report to the first respondent through the third respondent within a period of four weeks from the date of receipt of a copy of this order. On receipt of the report from the fifth respondent, the first respondent shall consider the request of the petitioner for issuance of patta and pass final orders on its own merits within a further period of twelve weeks.

7. With the above directions, this Writ Petition is disposed of. No costs.
