Heard the learned counsel on either side.
2. This Criminal Original Petition has been filed to direct the 1st respondent not to harass the petitioners under the guise of enquiry.
3.The learned counsel for the petitioner would submit that the petitioner and the second respondent are husband and wife. Based on the complaint prefered by the second respondent, the petitioners were called for enquiry by the 1st respondent. According to the petitioners, they were appeared before the 1st respondent for enquiry. Even then, the respondent police is calling the petitioners for enquiry so many times and harassing them without any reason. Hence, this petition.
4. When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the official respondent, on instructions, would submit that, the second respondent has preferred a complaint against the petitioners, based on which, summons has been issued to the petitioners. He would further submit that both the parties had not attended the enquiry and therefore, the complaint has been closed on 15.11.2020.
