Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of writ of Certiorarified Mandamus calling for the records relating to the Charge Memo bearing Ref.No.Secy./Confdl./2016/D 2707, dated 25.07.2016 issued by the respondent read with the suspension order bearing reference No.SECY/Confdl./2106/D 2262 dated 18.06.2016 issued by the respondent Port Trust and quash the same as being illegal, arbitrary and unconstitutional and consequently issue a direction to the respondent to sanction the leave applied by the petitioner as such, with all attendant service benefits within a time frame to be fixed by this Court.

ORDER

When the matter is taken up for hearing, the learned Counsel appearing for the petitioner would submit that he would be satisfied if the reviewing authority would dispose of the review petition dated 15.03.2018.

2. At this juncture, the learned Assistant Solicitor General of India would submit that time may be fixed for the respondent to dispose of the review petition said to have been filed by the petitioner.

3. Considering the limited scope of the prayer as sought during the course of argument, the writ petition is disposed of with the following direction:

"The respondent is directed to place the matter i.e., Review Petition dated 15.03.2018 before the competent board for its consideration and for appropriate orders to be passed on merits and in accordance with law. The order should be passed on the review petition filed by the petitioner by the competent authority within a period of four weeks from the date of receipt of a copy of this order."

No costs. Consequently, the connected Miscellaneous Petitions are closed.
