O R D E R
[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted seeking to consider the petitioner's representation dated 05.04.2025 and to direct the respondents 2 and 3 and 12 to 14 to initiate enquiry on the atrocities of the fifteenth respondent and filing of false complaints and misusing of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
2. The petitioner has also sought for an interim direction to
appoint a Committee consisting of the retired Judges for the purpose of conducting enquiry in order to bring the fact of misuse of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
3. Learned Standing Counsel appearing for the Bar Council of Tamil Nadu & Puducherry would submit that complaints were addressed to various authorities, however, they were not in the prescribed format. In the event of the petitioner submitting a complaint in the prescribed format, the Bar Council of Tamil Nadu & Puducherry will consider the same in accordance with law.
4. Insofar as the allegation regarding misuse of the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, is concerned, the petitioner appearing in person would submit that a complaint has already been lodged and the police authorities have registered a first information report.
5. That being so, the petitioner is at liberty to seek appropriate remedy before the competent authority or the court of law, as the case may be.
However, the disputed facts of this nature cannot be adjudicated by the High Court. Therefore, granting liberty to the petitioner to work out her remedy before the Bar Council of Tamil Nadu & Puducherry and also the authorities competent, in accordance with law, this writ petition is disposed of.
