3.S.T.Adhithan @ Rajesh 4.S.T.Vikram Adhithan : Respondents Prayer: Petition is filed under Section 482 of the Criminal Procedure Code to direct the second respondent not to interfere in the civil dispute and further not to harass the petitioner in anyway under the guise of enquiry.

O R D E R

This petition has been filed seeking a direction to the second respondent Police not to harass the petitioner. 2.According to the petitioner, he is a cultivating tenant under the respondents 3 and 4 and a civil suit is also pending between them. Pending civil suit, in order to evict the petitioner, a false complaint has been given against the petitioner. Based on the said complaint, the second respondent is harassing the petitioner and also taking steps to evict him. Hence, the present petition has been filed.

3.Today, when the matter was taken up for hearing, the learned Government Advocate (Criminal side) appearing for the State, on instructions, submitted that this is a case and counter, earlier based on the complaint given by the petitioner, a crime has been registered against the respondents 3 and 4, and in a counter blast, the respondents 3 and 4 has filed the present complaint and now the investigation is pending on both the cases. However, he further submitted that the second respondent has not harassed the petitioner.

Crl.O.P.(MD) No.11249 of 2019 4.Recording the above said submission made by the learned Government Advocate (Criminal side), the investigation is pending between both the complaints, the respondent Police is directed to proceed with the investigation and during the investigation, the respondent Police is directed not to harass the petitioner under the guise of investigation.

5.The Criminal Original Petition stands disposed of accordingly.
