ORDER

Seeking to direct the respondents 1 and 2 to take appropriate action based on the petitioner's complaint dated 29.04.2026, this writ petition is filed.

2. Since no adverse order has been passed as against the private respondents, notice to the private respondents is dispensed with.

3. The learned counsel for the petitioner submitted that dispute with respect to pathway had erupted between the petitioner and the private respondents 3 to 5. As a result of which, a physical and verbal altercation had happened between the rival parties, and the petitioner had sustained grievous injuries. Pursuant to which, he had lodged a complaint on 29.04.2026. The same is not properly dealt with by the 2nd respondent police. Hence, this writ petition.

4. The learned Government Advocate(Crl.side) submitted that already prompt action was taken and the petitioner was summoned on 07.05.2026 and 10.05.2026, for which he did not turn up. The 2nd respondent police not able to proceed with the enquiry only because of the non-cooperation of the petitioner. Recording the same, the complaint was closed. 2/4

5. Heard the learned counsel on either side and carefully perused the materials available on record.

6. In this regard, the petitioner is directed to forthwith proceed to the 2nd respondent police station and provide all the necessary documents and other details, which would substantiate his claim. Thereafter, the 2nd respondent police is directed to put the petitioner as well as the respondents 3 to 5 on notice under Section 64 BNSS and conclude the enquiry within a period of four

(4) weeks from the date of receipt of copy of this order. It is made clear that the petitioner should not be subjected to any harassment when he proceeds to the police station for seeking appropriate action.

7. With the above directions, this Writ Petition stands disposed of. 10.06.2026 NCC : Yes / No Index : Yes / No gbg 3/4
