For Petitioner : Mr.P.T.Ramesh Raja For Respondents : Mr.SS.Madhavan Government Advocate (Crl.side) O RDER This petition is filed seeking for a direction to transfer the investigation in Crime No.80 of 2023 from the file of the second respondent police to the respondent No.3 police.
2.According to the learned counsel for the petitioner, on a complaint given by the petitioner, a case has been registered for the offence under Sections 147, 341, 448, 294(b), 323, 324 and 506 (2) IPC against the accused in Crime No.80 of 2023 on 01.05.2023, who has attacked the petitioner on 01.05.2023 at about 03.00 pm., wherein the petitioner stated to have received multiple injuries on his body and was admitted in the hospital. The grievance of the petitioner is that though he has received multiple injuries and an attempt was made on his life, the police have not registered the First Information Report under Section 307 IPC and that no offence is added in the First Information Report for killing the dog belonging to the defacto complainant by the accused. 2/5
3.The learned Government Advocate (Crl.side) submits that the police have filed a memo of alteration including Section 307 IPC in the First Information Report and that he will instruct the Investigating Officer to include the relevant penal Sections for killing the dog and reported that so far more than 15 witnesses have been examined and requests 8 weeks time to complete the investigation. 4.By recording the submissions made by the learned Government Advocate (Crl.side), the respondent police are directed to complete the investigation within a period of 8 weeks from the date of receipt of a copy of this order. The petitioner/defacto complainant is also instructed to co-operate with the investigation and provide the information, if any, in respect of the crime alleged to have been committed.
