Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.RAMESH RAJA P T, Advocate for the petitioner and of Mr.S.MANIKANDAN, Government Advocate (crl.side) on behalf of the 1st Respondent and MR.G.ARAVINDAN, Advocate for the Respondent No.2, the court made the following order:- 1/4
A report has been called for from the trial Court as to the date of the filing of the alteration report. The said report is received stating that the alteration report was received on 02.08.2023. Before that date, Crl.O.P.(MD)No.8616 of 2023 was entertained by this Court, on the ground that the offences under Section 324 of IPC is mentioned.
2. The learned counsel for the petitioner would submit that he suffered grievous injuries and he was in the bed for about 27 days. It is also submitted that he underwent three surgeries but those things was not taken into account. However, subsequent to passing of the order, alteration report has been passed.
3. The respondent police has made a spot visit and stated that he recovered fully from the injuries and he is also attending his usual routine work also.
4. It is seen that final report has been filed on 08.08.2023 but not taken on file by the learned Judicial Magistrate No.III, Madurai. 2/4
5. Learned Judicial Magistrate No.III, Madurai, is directed to process the final report and to take cognizance as per rules.
6. I find no reason to cancel the bail at this stage. Accordingly, this Criminal Miscellaneous Petition is dismissed.
