BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 16.06.2026

CORAM:

THE HONOURABLE MR.JUSTICE MUMMINENI SUDHEER KUMAR Sabareswaran ... Petitioner -vs1.The Secretary to Government Higher Education Department Chennai 2.The Member Secretary Tamil Nadu State Council for Higher Education Chennai-5 3.The Chairman Teachers Recruitment Board Chennai-6 4.The District Collector District Collector's Office Madurai ... Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents to permit the petitioner to participate in the Teachers Recruitment Board (TRB) examination to the post of Post Graduate Teacher / P.G. Assistant (Physics) to consider the petitioner

for selection and appointment to the post of Post Graduate Teacher / P.G.Assistant (Physics) by considering the petitioner's representation dated 08.05.2026.

For Petitioner :

Mr.K.Neelamegam For Respondents :

Mrs.K.Porkodi Counsel for the Government for R1, R2 & R4 Mr.T.Amjad Khan Standing Counsel for R3

O R D E R

This writ petition has been filed seeking a writ of mandamus directing the respondents to permit the petitioner to participate in the Teachers Recruitment Board's Examination for the post of Post Graduate Teacher / P.G. Assistant (Physics) enabling him to be appointed as Post Graduate Teacher / P.G.Assistant (Physics), by considering the representation dated 08.05.2026 said to have been submitted by him.

2. The case of the petitioner is that after having completed B.E.Electronics course, he has completed B.Ed., course and thereafter completed M.E.Electronics course. But, the said M.E.Electronics course is not being accepted as the qualification for the post of Post Graduate Teacher /

P.G.Assistant (Physics) and therefore, the petitioner is not being allowed to participate in the recruitment process that is being initiated by the Teachers Recruitment Board and therefore, the petitioner has approached this Court by filing the present writ petition.

3. Learned counsel for the petitioner contended that the Government of Tamil Nadu, having accepted M.Sc., Physics as equivalent to M.Sc., (Physics) Electronics awarded by Sri Venkateswara University, Tirupati, has not issued any orders treating M.E.Electronics as equivalent to M.Sc., Physics so as to be eligible for the purpose of employment in public services, in an arbitrary manner.

4. The question of permitting the petitioner to participate in the recruitment process to be initiated by the Teachers Recruitment Board is only when a notification is issued by the Teachers Recruitment Board for filling up the post of Post Graduate Teacher / P.G. Assistant (Physics). As on date, admittedly, there is no such notification issued by the Teachers Recruitment Board. In the absence of any such notification, the petitioner herein has no cause of action for filing the present writ petition nor this Court can grant any relief at this stage.

5. Be that as it may, the grievance of the petitioner appears to be not considering the M.E.Electronics qualification possessed by him as an equivalent qualification prescribed for the post of Post Graduate Teacher / P.G. Assistant (Physics). If that is the grievance of the petitioner, it is for him to approach the Government of Tamil Nadu seeking appropriate orders. But, in the instant case, there is nothing on record to show that the petitioner has made any such attempt before the Government of Tamil Nadu. In the circumstances, this Court is not inclined to entertain this writ petition at this stage.

6. Accordingly, this writ petition is dismissed. However, it is made clear that in case if the petitioner intends to approach the Government of Tamil Nadu seeking to treat the Degree of M.E.Electronics possessed by him as equivalent to any other qualification, it is open for him to take all such steps in accordance with law. No costs.
