PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondent No.3 to take appropriate action on petitioner's representation, dated 05.05.2025 and thereby initiate necessary enquire and to take suitable action within a reasonable time to be fixed by this Court.

ORDER

This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and learned Government Advocate for the respondents, after dispensing with the notice to the fourth respondent as no adverse orders are proposed to be passed.

2. The petitioner appears to be a member of the fourth respondent/Society, claiming himself as permanent Executive Member.

3. It is the case of the petitioner that the affairs of the fourth 2/6

respondent/Society has not been conducted in an orderly manner and the relevant reports that may require to be filed under the provisions of the Tamil Nadu Societies Registration Act, 1975, has not been complied with by the person -in-charge, along with the petitioner. Hence, the petitioner has given a representation, dated 05.05.2025 to not to permit that 19 Executive Members to function as Executive Members and to operate bank account to the affairs of the Society.

It appears that a rival group represented by one S.R.Eswarlal had also approached this Court in W.P.(MD) No.4238 of 2025, for a Mandamus to direct the Official respondents therein to register the elected 19 Executive Committee Members list of the fourth respondent/Society in the years 2024 to 2027, based on the representation, dated 28.01.2025, within stipulated time period. The said Writ Petition came to be disposed of on 18.02.2025, with the following observation: "7. In the light of the above observations, there shall be a direction to the respondents 1 to 3 herein to consider the petitioner's representation dated 28.01.2025, on its own merits and pass appropriate orders in accordance with law, after giving due opportunity to the petitioner, as well as all other persons, who may be interested in the subject matter, within a period of one month from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with 3/6

regard to the merits of the matter and that it is open to the respondents 1 to 3 to consider the same on its own merits."

5. The third respondent is seized off the issue, pursuant to the aforesaid order, dated 18.02.2025 of this Court in W.P.(MD) No.4238 of 2025 filed by the said S.R.Easwarlal.

6. The prayer of the petitioner may also be considered and disposed of by the third respondent within a period of six (6) weeks from the date of receipt of a copy of this order in accordance with law, after due notice of the persons, who likely to be impacted to the order to be passed.
