Prayer:- This Writ Petition has been filed under the Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the first respondent relating to the Additional Chief Secretary / Transport Commissioner, Chennai passed in Lr.No. 14735/RA2/2020 dated 19.11.2020 and quash the above said orders and consequently direct the first respondent ie., the Additional Chief 1/6

Secretary / Transport Commissioner, Chennai to promote the petitioner on par with her juniors as Superintendent within a specified time frame that may as may fixed by this Court.

ORDER

This Writ Petition has been filed under the Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the first respondent relating to the Additional Chief Secretary / Transport Commissioner, Chennai passed in Lr.No.14735/RA2/2020 dated 19.11.2020 and quash the above said orders and consequently direct the first respondent ie., the Additional Chief Secretary / Transport Commissioner, Chennai to promote the petitioner on par with her juniors as Superintendent. 2.

Heard Mr.V.Kasiraja, learned counsel for Mr.S.Visvalingam learned counsel appearing for the Petitioner, Mr.P.Thambidurai, learned Government Advocate for the Respondents.

When the matter was taken up for hearing, Mr.P.Thambidurai, learned Government Advocate, produced an order dated 06.04.2022 before this Court and submitted that the prayer sought by the Petitioner had been granted, and the Petitioner was promoted as Superintendent, having fulfilled all the norms provided under Annexure IV of Rule 30(b) of the Special Rules. The promotion was granted under Section 47(1) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016. The learned Government Advocate thus prayed that, since the relief sought by the Petitioner had been granted, the Writ Petition may be disposed of in view of the order dated 06.04.2022. A copy of the said order was taken on record and furnished to the learned counsel for the Petitioner. 4.

Mr.V.Kasiraja, learned counsel for Mr.S.Visvalingam, learned counsel appearing for the Petitioner, submits that the Petitioner has received the copy of the order dated 06.04.2022. He further submits that since the relief sought by the Petitioner has been granted and the Petitioner has been granted promotion to the post of Superintendent under Section 47(1) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016, he prays that this Court dispose of 3/6

the Writ Petition accordingly.

After considering the submissions made by the learned counsel for both parties and perusing the order dated 06.04.2022, this Court finds that no useful purpose would be served by keeping this Writ Petition pending, as the relief sought by the Petitioner has been granted vide the order dated 06.04.2022.

Accordingly, in view of the order dated 06.04.2022 passed by the Respondents, this Writ Petition is finally disposed of. The file shall be consigned to the record. There shall be no order as to costs. There shall be no order as to costs.
