PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to take necessary action upon the petitioner's complaint dated 01.07.2022 which is pending before the respondents police. This writ petitioner filed this Writ Petition seeking a direction to the respondents to take necessary action upon his complaint dated 01.07.2022.
2.Mr.M.Sakthi Kumar, learned Government Advocate (Criminal Side) takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) submitted that the petitioner gave a complaint to the second respondent with regard to property in old Survey No.556/1 and new Survey No.277/1 in patta No.1361, in which, there existed some dispute between the petitioner and one Veerapathiran S/o.Periyakaruppan. The petitioner participated in the enquiry and gave a letter with regard to this property and another property. The Executive Officer, Gurunathaswamy temple, Kallikudi, gave a complaint to the District Registrar with regard to document registered in 707/1994 and another documents. In this regard, the District Registrar is free to hold enquiry and issue summons. Therefore, the complaint received from the 2/4
petitioner registered in CSR No.224 of 2022 is pending. The petitioner consent that he will subject to result of the District Registrar enquiry and he is ready to obey any order passed by the District Registrar. 4.Recording the submission of the learned Government Advocate (Crl. Side), the second respondent is hereby directed to take action in CSR No.224 of 2022 upon outcome of the result of the District Registrar with regard to the enquiry of the registration of the document in No. 707/1994.
5.With the above direction, this Writ Petition stands disposed of. No Costs.
