Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to issue passport to the petitioner on the basis of his passport application in TRI1064724624922 dated 31.10.2022 within a stipulated time as may be fixed by this Court.

ORDER

This writ petition is filed to direct the first respondent to issue passport to the petitioner, on the basis of his passport application in TRI1064724624922 dated 31.10.2022 within the stipulated time. 2.With the consent of both sides, the writ petition is taken up for final disposal at the time of admission.

3.The learned Government Advocate(Crl.side) appearing for the second respondent submits that only an FIR has been registered against the petitioner in Crime No.616 of 2022 on 28.09.2022 for offence under Sections 379 IPC and 21(1) of Mines and Minerals (Development and Regulation) Act, 1957. He however confirms no charge sheet has been filed till date. 4.Considering the same, there can be no impediment directing the respondents to issue passport to the petitioner based on the application filed by the petitioner as expeditiously as possible. However, the petitioner shall not travel abroad without the permission of the second respondent. 2/4

5.With the aforesaid direction, this Writ Petition stands disposed of. No costs.
