Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to issue passport to the petitioner on the basis of petitioner's application for passport in Passport Application No.TRI1075243346923 within a stipulated time as may be fixed by this Court.

ORDER

This writ petition is filed to direct the first respondent to issue passport to the petitioner, on the basis of his application for passport in Passport Application No.TRI1075243346923 within a stipulated time 2.With the consent of both sides, the writ petition is taken up for final disposal at the time of admission.

3.The learned Government Advocate(Crl.side) appearing for the second respondent submits that an FIR has been registered against the petitioner in Crime No.497 of 2022 on 12.09.2022 for offence under Sections 379 IPC and 21(1) of Mines and Minerals (Development and Regulation) Act, 1957. The learned Government Advocate(Crl.side) further submitted that the investigation has been completed. However, submits charge sheet has not been filed before the concerned Court.

4.Considering the same, there can be no impediment directing the respondents to issue passport to the petitioner based on the application filed 2/4

by the petitioner, within a period of 6 weeks from the date of receipt of a copy of this order. However, the petitioner shall not travel abroad without the permission of the second respondent.

5.With the aforesaid direction, this Writ Petition stands disposed of. No costs.
