ORDER
This petition has been filed to direct the Inspector of Police, District Crime Branch, Pudukkottai District, the 3rd respondent herein, not to harass the petitioner under the garb of conducting inquiry into a complaint lodged by the 4th respondent. 2.Heard the learned counsel for the petitioner, the learned Additional Public Prosecutor (Criminal Side) for the official respondents and the learned counsel for the third respondent. 1/3
3.The learned counsel for the petitioner would submit that the petitioner worked in Singapore for 13 years and he is arranging employment at Singapore for the needy persons. During the course of his business, the 4th respondent approached the petitioner and requested to arrange a job opportunity at Singapore. Accordingly,the petitioner has arranged a job through a private employment company at Singapore. As per the terms, the 4th respondent has paid a sum of Rs.4,00,000/- to the said private employment Company. Out of the said amount, the petitioner has received Rs.27,000/- towards commission and the balance amount of Rs.3,73,000/- was retained by the said private employment company. As per the agreed terms, the 4th respondent got an employment through the above said private employment company and he also went to Singapore on 28.02.2020.
Subsequently, as the 4th respondent was not working to the satisfaction of the employer, he was terminated from the service and a sum of Rs.1,92,000/- was also refunded to the 4th respondent. Thereafter, the 4th respondent approached the petitioner and threatened him to return the amount. In this regard, the petitioner lodged a complaint before the North Police Station, Karaikudi and Pallathur Police Station,Sivagangai. In the meantime, the 4th respondent has lodged a false complaint against the petitioner before the Pudukkottai Town Police Station, for which, the petitioner was made to run one station to another. Hence, he sent a representation to the 3rd respondent on 16.11.2020 and the same has not been considered so far. Hence, this petition. 4.
The learned Additional Public Prosecutor, on instructions, would submit that, based on the complaint given by the petitioner before the North Police Station, Karaikudi and Pallathur Police Station,Sivagangai, enquiry was conducted. The enquiry revealed that the 4th respondent has given a statement stating that he will approach the concerned Court for his remedy, accordingly the enquiry was closed. Again, the petitioner has sent a representation to the first respondent on 16.11.2020 for the same issue. Since the complaint regarding the issue has already been closed, the police will not interfere with the above matter.
5.Recording the above submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is closed.
