PRAYER :- For Bail in Crime No.288 of 2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners/Accused herein, who were arrested on 05.06.2023 for the alleged offence under Sections 381, 411, 414 of IPC, in Crime No.288 of 2023, on the file of the respondent police, seek bail.
2.The case of the prosecution is that the accused persons, who are the erstwhile employees of the defacto complainant had committed theft of vessels worth about Rs.4,55,000/- from the shop of the defacto complainant. Hence the complaint. 3.The learned counsel for the petitioner submitted that the petitioners are innocent persons and they were falsely implicated in this case, based on the confession of co-accused. They have not committed any offence as alleged by the prosecution. Hence, prays to enlarge them on bail.
4.The learned Additional Public Prosecutor submitted that the accused had committed theft of vessels from the shop of the https://www.mhc.tn.gov.in/judis 1/2

Though the petitioner is not having any bad antecedent, the alleged articles have been recovered from the coaccused namely Murugan. 5.Considering the fact that the alleged articles were recovered from the co-accused and the petitioners are the erstwhile employees of the defacto complainant, also the petitioners are not having any previous case at their credit, this Court is inclined to grant bail to the petitioners with certain conditions. 6.Accordingly, the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Kumbakonam, and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders.
