Writ Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the 1st respondent herein to dispose of petitioner's appeal dated 13.04.2016 challenging the order passed by the 2nd Respondent in O.Mu.19599/15Aa2 dated 29.01.2016 with regard to mutation of patta in respect of the petitioner's Landed Property to an extent 28 cents comprised in Survey No.22/2B1 situated at Koolapandi Village, Madurai North Taluk, Madurai District within the time stipulated by this Court.

ORDER

The petitioner has filed this writ petition, seeking a direction, directing the 1st respondent herein to dispose of his appeal dated 13.04.2016, challenging the order passed by the 2nd Respondent, dated 29.01.2016 with regard to mutation of patta in respect of his landed property, situated at Koolapandi Village, Madurai North Taluk, Madurai District within the time stipulated by this Court.

2.According to the petitioner, against the order passed by the second respondent/Tahsildar, he has filed an appeal before the first respondent, on 13.04.2016. Sofar, the first respondent has not taken necessary steps to dispose of the same. Hence, he has filed the present writ petition.

3. Heard the learned Government Advocate appearing for the respondent, who would submit, on instructions that the petitioner's appeal would be disposed of by the respondents, within a time frame.

4.In the above circumstances, without going into the merits of the case, the first respondent is directed to consider the petitioner's appeal dated 13.04.2016, after issuing notice to the petitioner and rival claimants and pass orders, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
