Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the respondents herein to pay 5% personal pay to the petitioners in accordance with G.O.Ms.N.664, dated 24.08.1992. For Petitioners : Mrs.AL.Ganthimathi For 1st respondent : Mr.N.S.Karthikeyan, Addl. Government Pleader For 2nd respondent : Mr.N.Mohideen Basha

O R D E R

[Order of the Court was made by R.SUBBIAH, J.] This writ petition has been filed by the petitioners seeking a direction to the respondents herein to pay 5% of personal pay to them in accordance with G.O.Ms.No.664, dated 24.08.1992. 2.It is stated in the petition that the petitioners herein are retired employees of the judicial department. They were served as Process Servers. Their duties and responsibilities were on par with the duties and responsibilities of the amins / senior bailiffs. The grievance of the petitioners is that though the Government issued G.O.Ms.No.664, dated 24.08.1992, granting 5% personal pay to various categories of staff and subsequently extended the same to some categories of judicial staff, the said benefit has not been extended to the category of Process Servers. Hence, they have come up with this writ petition. 3.The learned Additional Government Pleader appearing for the first respondent submitted if the petitioners give a joint representation, the same would be considered by the first respondent on merits.

4. In view of the above submission of the learned Additional Government Pleader, this Writ Petition is disposed of with a direction to the petitioners to give a joint representation to the first respondent within a period of four weeks from the date of receipt of a copy of this order and on receipt of such representation, the first respondent shall consider the same in accordance with G.O.Ms.No.664, dated 24.08.1992 and pass appropriate orders on merits and in accordance with law within a period of twelve weeks thereafter. No costs.
