ORDER
The learned counsel for the first respondent/writ petitioner would submit that the power of attorney agent of the petitioner had colluded with the newly proposed 8th respondent, a Doctor, and the subsequent purchaser, and had created a forged life certificate by forging the signature of the petitioner. He would further submit that the Doctor, without verifying the presence of the petitioner, who was then residing in Malaysia, had given a fraudulent life 2/6
certificate. On the strength of the said fraudulent life certificate, the document came to be registered earlier. Therefore, he would submit that this is an extraordinary case which ought to be dealt with by this Court and consequently, the interim injunction granted pending disposal of the writ petition should not be vacated.

Per contra, the learner counsel for the vacate stay petitioners would submit that, earlier, when the documents were held to be invalid by specific orders passed under Section 77-A of the Registration Act, 1908, they had filed a writ petition challenging the same by way of W.P(MD)No.13188 of 2023, and the same was allowed along with a batch of petitions in M.Kathirvel Vs. Inspector General of Registration reported in 2024 (4) CTC
769. Therefore, they would pray that the interim order cannot be granted in the present proceedings and that, even if the writ petitioner is aggrieved, he can only approach the civil Court, as directed in the Judgment inter parties.

In reply thereof, the learned counsel for the writ petitioner submits that, in some of the cases, in the operative portion of the very same Judgment, the High Court has interfered where there was rank forgery, impersonation etc.. The learned counsel would also rely upon the Judgment of this Court in 3/6
J.Jayaniithaa Vs. Inspector General of Registration [W.P(MD)Nos.18721, 18725 and 18730 of 2020, dated 15.12.2020] for the said purpose.
4. Whether this is a fit case for exercising the extraordinary jurisdiction of this Court for once again cancelling the deeds can be considered in the main writ petition. However, considering the prima facie plea that, with reference to the very same documents, this Court in M. Kathirvel vs. Inspector General of Registration, had still chosen to interfere in some of the writ petitions and did not interfere the matter any further observations in the present case, the prayer in the vacate stay petition filed by the petitioners is allowed.
5. I am of the view that the interim order is liable to be vacated, however the rights of the parties can be determined in the main writ petition. Accordingly, W.M.P.(MD)No.11413 of 2026 is allowed and the interim order granted in W.M.P.(MD)No.10536 of 2026 shall stand vacated. 6.Post the main writ petition on 01.07.2026.
