O R D E R

The petitioner/wife, who is facing the proceedings for divorce in H.M.O.P.No.83 of 2019 on the file of the SubCourt,Uthamapalayam, seeks transfer of the same to the file of Family Court, Madurai. The transfer is sought for solely on the ground of convenience of the wife.

2.The learned counsel appearing for the respondent would submit that the respondent is serving in the Indian Army in Arunachalpradesh and hence, it will be difficult for him to attend every hearing before the Family Court, Madurai.

3. Considering the said difficulty expressed, H.M.O.P.No.83 of 2019 is withdrawn from the file of the Sub Court, Uthamapalayam and transferred to the file of Principal Sub-Court, Madurai since the appearance of the respondent/petitioner in H.M.O.P.No.83 of 2019 for every hearing will not be required.

4. The Transfer Civil Miscellaneous Petition is accordingly allowed. The Sub-Court, Uthamapalayam is directed to transmit the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Tr.C.M.P(MD)No.318 of 2019 papers to the Principal Sub- Court, Madurai, forthwith, which shall dispose of the H.M.O.P., as expeditiously as possible. However, there will be no order as to costs. Consequently, connected miscellaneous petition is closed.
