This petition has been filed seeking direction to the respondents 1 & 2 to give adequate police protection on the basis of the representation dated 06.07.2021.
2. The case of the petitioner is that the petitioner is a ExService man and he is presently working as Driver in Tamil Nadu State Transport Corporation. The third respondent is the brother of sitting MLA belongs to a political party and the petitioner and his brother belong to some other political party and the brother of the petitioner is also sitting MLA. Because of the election dispute between them, the case in Crime No.37 of 2021 has been registered on the file of the second respondent police and after that the third respondent is continuously threatening the 1/3
petitioner with dire consequences based upon which the petitioner made a representation seeking police protection.
3. The learned Additional Public Prosecutor would submit that because of the political rivalry between two political parties, representation has been made by the petitioner seeking police protection and during the course of enquiry, he insisted that the matter must be enquired only by the Superintendent of Police. He did not cooperate with the enquiry officer to complete the enquiry and therefore, it was closed on 08.06.2021.
4. It appears that it is political dispute between two opposite political parties. A perusal of the closure report shows that because of the trouble between the parties, peace committee meeting was also arranged and the proceedings under Section 107 Cr.P.C has also been initiated. Because of the non-cooperation of the petitioner and finding that there is no life threat to the petitioner, it came to be closed. I find no merit in this petition. Recording the submission of the learned Additional Public Prosecutor and placing on record the copy of the closure report, this petition deserves dismissal and the same is dismissed.
