O RDER This petition is filed seeking for a direction to the third respondent police not to harass the petitioner.
2.It is submitted by the learned counsel for the petitioner that earlier the petitioner's younger brother has allegedly committed the offence punishable under Section 307 I.P.C., Since he was a juvenile, a charge sheet has been filed before the concerned Juvenile Justice Board and in that context, the police have harassed the petitioner and his mother, thereby she had made a complaint to the Human Rights Commission. It is submitted that keeping that grudge, the respondent No.2 and other police officials started harassing the petitioner and came to the house of the petitioner on 24.06.2023 at early morning 05.30 am., 3.The learned Government Advocate (Crl.side) appearing for the respondents submits that the petitioner is involved in Crime No.133 of 2023 registered for the offences punishable under Sections 294(b) and 353 IPC and 8(c), 20(b)(ii)(4) of the NDPS Act and that the petitioner is absconding and thereby the police are trying to find out him. 2/4
4.Since the respondent police went to the house of the petitioner to arrest him in criminal case, this Criminal Original Petition filed alleging that the respondent police are harassing will not lie. Hence, no order cane be passed. Accordingly, this Petition is dismissed.
