The Writ Petition has been filed seeking to quash the proceedings of the second respondent in Na.Ka.No.978/Aa4/2016 dated 20.07.2016.

2. Heard the learned counsel for the petitioners and the learned Government Advocate appearing for the official respondents.

3. The learned Government Advocate would submit that challenging the very same order, the petitioners have already filed an appeal before the first respondent, the District Registrar (Admn), Virudhunagar District, Virudhunagar, on 16.08.2016 and the same is pending before the first respondent. In the circumstances, once again, they have filed the present writ petition before this Court.

4. Since the petitioners have already filed a statutory appeal before the first respondent and the same is now pending, now they cannot challenge the very same proceedings. Hence, the writ petition is dismissed. However, the first respondent is directed to consider the petitioner's appeal, dated 16.08.2016, and pass suitable orders on merits and in accordance with law, after issuing notice to the parties concerned, within a period of twelve weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected Miscellaneous Petition is closed.
