Respondents PRAYER:- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the Respondents, particularly the second Respondent, to consider and dispose of the representation dated 20.03.2026, submitted through the proper channel, the fourth respondent, seeking disbursement of maternity 1/5

benefits for the period from 08.08.2024 to 01.06.2025, and consequently direct the respondents to sanction and disburse the maternity benefits and all consequential monetary benefits legally due and payable to her along with interest at 12 percent within a time frame to be fixed by this Court. ORDER

The petitioner herein, who was appointed as the Assistant Surgeon in Neonatology Department of Madurai Medical College, complied with the compulsory bond executed by her while taking admission in Post Graduate course. Immediately thereafter, the petitioner conceived and she was permitted to avail Maternity Leave from 08.08.2024 to 01.06.2025 and thereafter, the petitioner has been continuing in her service. However, the petitioner is not paid the salary and other monetary benefits during the period of Maternity Leave and hence, the petitioner claimed to have submitted a representation dated 20.03.2026 before the second respondent. As the second respondent is not taken any steps on the said representation, the petitioner has approached this Court by filing the present writ petition.

2. Mr.M.Dinesh Harisudarsan, learned counsel for the Counsel for Government, on instructions, submits that the identical matters were disposed of by this Court and the petitioner would be allowed to draw all the monetary benefits for Maternity Leave period already availed by her.

3. Without going into the merits of the matter, this writ petition is disposed of directing the second respondent to consider the representation dated 20.03.2026 submitted by the petitioner and pass appropriate orders for releasing monetary benefits for the Maternity Leave availed by her at any rate within a period of two months from the date of receipt of a copy of this order.
