This petition has been filed seeking police protection to her life and limb based on the representation dated 01.08.2019.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the official respondents. Considering the nature of the order going to be passed in this petition, notice to the private respondents is dispensed with.
3. According to the petitioner, there is a matrimonial dispute between the petitioner and the third respondent / husband of the petitioner herein. Matrimonial proceedings were also pending between them. Now alleging that the third respondent is not permitting the petitioner to enter into the matrimonial house and also threatened her with dire consequences, the petitioner has filed a representation to the first respondent seeking police protection. Today, when the matter was taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the respondents, on instructions, would submit that the third respondent / husband of the petitioner has made a complaint stating that the petitioner is found missing. In the above said complaint, one Chellapandi, with whom the petitioner is alleged to have eloped, has filed an application seeking anticipatory bail before this Court, in the above matter he appeared before this Court and made a statement that the petitioner has left the matrimonial home on her own volition and no one has illegally detained her. Consequentially, the petitioner also appeared before the second respondent police and made a statement that she left the matrimonial home on her own and she is now residing in Tirupur. Based on the petitioner's statement, the complaint has been closed.
5. Considering the fact that the petitioner has appeared before the respondent police and given a statement that she has left the matrimonial home on her own and also stated that he is living in Tirupur, the prayer as such sought for by the petitioner cannot be granted at this stage. Accordingly, this Criminal Original Petition is dismissed.
