O R D E R

The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the first respondent to take appropriate action against the third respondent based on the noise level test report issued by the second respondent.

2.The petitioner contends that the third respondent is operating a steel manufacturing unit in the premises adjacent to the petitioner's residence. According to the petitioner, the unit is being run in violation of the prescribed norms and is causing excessive noise pollution in the locality.

3.It is stated that, pursuant to a complaint lodged by the petitioner, the second respondent conducted a spot inspection and submitted a noise level test report. The said report allegedly indicates that the noise generated by the third respondent's unit exceeds the permissible limits 2/5

prescribed under the relevant regulations.

4.The grievance of the petitioner is that, despite the adverse findings contained in the noise level test report, the first respondent has not initiated any action against the third respondent. 5.The learned counsel appearing for the respondents submitted that, based on the report furnished by the second respondent, a notice has already been issued to the third respondent and that further action would be taken in accordance with law within the time frame stipulated by this Court. The said submission is placed on record. 6.In view of the aforesaid submission, this Court is inclined to dispose of the writ petition by directing the first respondent to consider the report and proceed further in accordance with law. 7.Accordingly, the writ petition stands disposed of with a direction to the first respondent to consider the noise level test report submitted by the second respondent and pass appropriate orders on merits and in 3/5

accordance with law, after affording due opportunity to the affected parties.

8.The aforesaid exercise shall be completed within a period of four

(4) weeks from the date of receipt of a copy of this order. 9.There shall be no order as to costs.
