For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.200 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/Accused No.2, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Sections 379 IPC r/w.21(4) of Mines 1/4

and Minerals (Development and Regulations) Act, 1957, in Crime 200 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and others were found in illegal transportation of 1⁄4 unit of river sand using bullock cart without valid permission and license and the same was seized by the resondent Police. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and is no way connected in this case. The false cae has been foisted against him only for the statistical purpose.

4. The learned Government Advocate (Crl. Side) would submit that the petitioner is having one previous cases, which is similar in nature.

5. Considering the facts and circumstances of this case and considering that the petitioner is having one previous case in similar nature, this Court is not inclined to grant anticipatory bail to the petitioner. Hence this anticipatory bail petition stands dismissed.
