O R D E R
*********** [Order of the Court was made by S.NAGAMUTHU, J.] The petitioner challenges the notice issued by the Revenue Inspector, Kadaiyam, Ambasamudram Taluk, under Section 7 of the Tamil Nadu Land Encroachment Act in respect of the land comprised in Survey No.570/25 at South Kadaiyam Village. Challenge is made mainly on the ground that though the Revenue Inspector has got power to issue a notice under Section 7, the impugned notice is not, in fact, a notice and it is an order for eviction.
2. In our considered view, as rightly contended by the learned counsel for the petitioner, the Revenue Inspector has got no power to order for eviction and he has got power only to issue notice. Therefore, we direct that the impugned notice shall be treated as a notice issued under Section 7 of the Tamil Nadu Land Encroachment Act, for which, the petitioner shall submit her explanation, within a period of fifteen days from the date of receipt of a copy of this order and thereafter, the Revenue Inspector shall submit a report to the Tashildar concerned, who shall pass appropriate orders.
