O R D E R

This Contempt Petition has been filed to punish the contemnors/respondents for wilfully disobeying and not complying with the order passed by this Court in W.P.(MD)No.5202 of 2021, dated 10.03.2021.

2. The petitioner has filed a writ petition bearing W.P.(MD) No. 5202 of 2021 seeking for a Writ of Mandamus directing the respondents to pay interest at the rate of 18% per annum on the belated payment of the retirement benefits from 01.02.2019 to 24.01.2021.

3. This Court, vide judgment and order dated 10.03.2021, had disposed of the said writ petition with the following directions:- 2/6

"7. In this background, there shall be a direction to the respondents to pay the interest to the petitioner at the rate of 6% per annum on the belated payment of the retirement benefits, commencing from the date of retirement, till the date of actual disbursement, within a period of six months from the date of receipt of a copy of this order."

When the matter was taken up today, Mr.S.C.Herold Singh, learned Standing Counsel for the second respondent submits that in compliance of the order passed in W.P.(MD) No.5202 of 2021, dated 10.03.2021, the first respondent has passed an order in Ref.No.TNSTC/TRY/SM1/2124/2021, dated 01.03.2025, in which it has been stated that the second respondent has made the payment to the petitioner, as per the directions issued by this Court, vide order dated 10.03.2021. Thus, he submits that the order of this Court has been fully complied with by the first respondent and as the amount has already been 3/6

paid to the petitioner, the respondents may be discharged from the contempt proceedings and the Contempt Petition may be disposed of.

Mr.S.Arunachalam, learned Counsel for the petitioner has no objection to discharge the respondents from the present contempt proceedings, as the order passed by this Court in W.P.(MD)No.5202 of 2021 dated 10.03.2021 has been fully complied with by the first respondent, vide order, dated 01.03.2025 and no amount payable by the respondents is due to the petitioner. A copy of the order passed by the first respondent in Ref.No.TNSTC/TRY/SM1/2124/2021 dated 01.03.2025 has also been received by the petitioner before this Court.

Accordingly, in view of the submissions made by the learned counsel for the parties and after perusal of the order passed by the first respondent, dated 01.03.2025 in Ref.No.TNSTC/TRY/SM1/2124/2021, this Court satisfied that the direction issued by this Court in W.P. (MD).No.5202 of 2021, dated 10.03.2021, has been complied with by the 4/6

first respondent and no useful purpose will be served in continuing the present contempt proceedings against the respondents. Accordingly, the Contempt Petition is disposed of and the respondents are discharged from the present contempt proceedings. No costs. The file is consigned to record.
