Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents 1 to 5 herein to consider and pass appropriate orders on the petitioner's representation dated 10.11.2016 in the light of the memorandum issued by the 3rd respondent dated 10.09.2016 in O.Mu.No.011551/2016/Pi2 and letter issued by the 1st respondent dated 11.01.2013 in Na.Ka.No. 945/13/G5.

ORDER

This writ petition has been filed directing the respondents 1 to 5 herein to consider and pass appropriate orders on the petitioner's representation dated 10.11.2016, in the light of the memorandum issued by the 3rd respondent dated 10.09.2016 in O.Mu.No.011551/2016/Pi2 and letter issued by the 1st respondent dated 11.01.2013 in Na.Ka.No. 945/13/G5.

2.According to the petitioner, there is a civil dispute pending between the petitioner and the sixth respondent. Now, pending litigation, the sixth respondent sold the property in favour of the 7th respondent and the seventh respondent is taking steps to change the patta in his name. In the above circumstances, the petitioner filed an application before the third respondent/Tahsildar , Madurai North Taluk, raising his objection on the same. The above application is pending. Hence, he has filed the present writ petition.

3.The learned Government Advocate, appearing for the respondents, on instructions, would submit that as on date, there is no application filed by the seventh respondent seeking transfer of patta in his name and it is only the apprehension of the petitioner that there is a likelihood of the 7th respondent to file an application for transfer of patta.

4.In view of the above submissions, in the event of the seventh respondent filing any application for transfer of patta in his name, the third respondent/Tahsildar, Madurai North Taluk is directed to consider the objection filed by the petitioner and pass orders on merits and in accordance with law. 5.Accordingly, this writ petition is disposed of. There shall be no order as to costs.
