Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to measure and demarcate the properties comprised in Old S.No.700/1, New S.NO.311/1 to an extent of 2018 sq.ft situated at Nilaiyur Village, Thirupparankundram Taluk, Madurai District and on the basis of the application dated 15.8.2025.

O R D E R

By asserting title over an extent of 2018 sq.ft forming part of a larger extent in new S.No.311/1, the Petitioner seeks direction for measuring and demarcating his property.

2.Learned counsel for the Petitioner relies upon a sale deed dated 16.7.2019 executed pursuant to power of attorney dated 27.10.2025. He further submits that he would be in a position to apply for issuance of patta only on completion of survey. 3.Learned Additional Government Pleader accepts notice for the respondents. He submits that patta is currently in the name of predecessor in interest of Petitioner and not in the name of Petitioner.

4.Upon cxonsidering the aforesaid, without expressing any opinion on the merits of the matter, first respondent is directed to consider the request of the Petitioner for conduct of survey after providing a reasonable opportunity to the Petitioner, any other person interested in the relevant property and owners of the neighbouring lands. The request shall be disposed of within a period of 12 weeks from the date of receipt of a copy of this order. 2/4

5.With the above directions, the Writ Petition stands disposed of. No costs.
