PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, by directing the 2nd respondent not to interfere into the Rights of employment of the Members of petitioners association, which is the subject matter pending before the Deputy Commissioner of Labour (Arbitration), Dindigul in Na.Ka.No.AA1/15290/2024, dated 15.05.2025.

The petitioner/ the President of Tamil Nadu Hospitals Sanitary Workers Welfare Association has filed this writ petition, for a Mandamus, directing the Inspector of Police, Pasupathipalayam Police station, not to interfere into the rights of employment of the Members of petitioner's Association, which is the subject matter pending before the Deputy Commissioner of Labour (Arbitration), Dindigul in Na.Ka.No.AA1/15290/2024, dated 15.05.2025. 2.The learned counsel for the petitioner Association submits that they have already filed an application before the Deputy Commissioner of Labour under Section 2K of the Industrial Dispute Act and obtained an order. However, the same has not been implemented by the Management and the Management is preventing the members of the petitioner Association, from executing their work, pursuant to the orders of the Labour Court. 3.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, who takes notice for the respondents submits that 2/5

they have not interfered with the rights of the members of the petitioner's Association. They have conducted Dharna in front of the hospital and also inside the hospital, thereby they have prevented the officials from discharging their duties. That apart, they have prevented the patients from entering into the hospital. At that point of time, they have interfered and advised the parties to work out their remedy before the Labour Court and in fact, they have not interfered with their rights, as claimed by the petitioner's Association.

4.Recording the aforesaid submissions of the learned Additional Public Prosecutor, this writ petition is closed with liberty to the petitioner to work out their remedy before the appropriate forum.
