PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to quash the entire relevant records related to the impugned Refusal Check Slip issued by the respondent in RFL/Thiruppuvanam/27/2025 dated 27.05.2024, and consequently to direct the respondent to register the Judgment and Decree passed by the District Muncif Court, Sivagangai in O.S.No. 203 of 1985, made on 08.09.1987, Vide Acknowledgement Receipt No. TP/220887227/2025 dated 27.05.2025. ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned Refusal Check Slip dated 27.05.2024 and consequently to direct the respondent to register the Judgment and Decree passed by the District Munsif Court, Sivagangai in O.S.No. 203 of 1985, made on 08.09.1987.

2. The learned counsel for the petitioner submitted that the respondent has refused to register the Judgment and Decree stating that already a settlement deed was executed for the said survey number.

3. The contention of the petitioner is that the settlement deed was put to challenge in the said suit and the suit was decreed in favour of the petitioner. Therefore, the petitioner is seeking to register the said Judgment and Decree. Therefore, the allegation of double entry would not arise.

4. Therefore, the Refusal Check Slip dated 27.05.2024 is hereby quashed. The respondent is directed to register the Judgment and Decree passed by the District Munsif Court, Sivagangai in O.S.No. 203 of 1985, made on 2/4

08.09.1987 within a period of four weeks from the date of receipt of a copy of the order.

5. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently connected Miscellaneous petition is closed.
