Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, to withdraw the case in Crime No.334 of 2025 from the 3rd respondent herein and transfer to any other investigation agency and to file a final report within the stipulated time as fixed by this Court.

ORDER

The petitioner / defacto complainant in Crime No.334 of 2025 has filed this petition to transfer the case from the 3rd respondent to any other investigation agency.

2.The petitioner claims that he is a public spirited person. He has filed public interest litigation to remove encroachments against one Pandikannan and others and therefore, they have assaulted him in front of the police station. Though he has lodged a complaint it is registered in CSR No.331 of 2021 and it is pending. Therefore, the petitioner apprehends that they would not conduct proper investigation in Crime No.334 of 2025 and seeks to transfer the said case to some other investigating agency.

3.The learned Additional Public Prosecutor on instructions submits that they have completed the investigation and filed the final report on 24.06.2025 before the learned Judicial Magistrate No.I, Sivagangai and it is yet to be taken on file. The other complaints lodged by petitioner had already been enquired and closed.

4.Since the final report has already been filed, this petition is closed. The respondent police shall take necessary steps and follow it up with the court for ensuring that the final report is taken on file within a stipulated time. The respondent police shall also furnish the closure report in other complaints to the petitioner. 25.06.2025 DSK To 1.The Inspector of Police, Sivagangai District.
