ORDER : The Court made the following order :- The petitioner, who is arrayed as accused (Rank not known) apprehending arrest at the hands of the respondent police for the offence punishable under Section 379 of IPC, in Crime No.350 of 2019, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant parked the bullet two wheeler in front of his house and the same was stolen by somebody. Hence, the complaint.
3.It is seen that this is the second application seeking anticipatory bail. The earlier anticipatory bail application in Crl.OP(MD)No.12102 of 2020 was dismissed on merit by this Court on 03.11.2020 that the petitioner was having six previous cases similar https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.14265 of 2020 in nature. Further, the rank of the accused is not important factor since he is having specific overt act on the case of impersonation. 4.Taking into consideration of the fact that there is no change of circumstances after dismissal of the earlier bail application in Crl.OP(MD)No.12102 of 2020, this Court is not inclined to grant anticipatory bail to the petitioner.
5. Accordingly, this Criminal Original Petition stands dismissed.
