The petitioner/Accused, who apprehends arrest at the hands of the respondent for the offences punishable under Sections 296(b), 118(1), 351(2) of BNS, 2023, and Section 4 of Tamilnadu Prohibition of Women Harassment Act, 2022, in Crime No.138 of 2026 on the file of the respondent police, seek anticipatory bail.
2.When the matter is taken up for hearing today, the learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that the offences are bailable in nature. Hence, he prayed to dismiss this petition.
3.This Court perused the materials available on records. 4.As per the FIR, the above said offences are bailable in nature and therefore, the question of granting anticipatory bail will not arise and it is not appropriate to consider the anticipatory bail application and the same is not maintainable.
5.Accordingly, this Criminal Original Petition stands disposed of 2/4
with liberty to the petitioners to approach the concerned appropriate forum by filing appropriate petition in accordance with law. (P D B J) 09.06.2026 dss TO 1.The Inspector of Police, Watrap, Police Station, Virudhunagar District.
