ORDER

The petitioner is an erstwhile trustee of Ammalu ammal & Guruvammal Trust. As per the civil Court order and the scheme, the trustee of the trust was appointed for every two years. After the year 2016, there was no appointment. 1/4

Hence, the petitioner sent a representation, dated 27.06.2022 to the Commissioner, HR&CE Department but no action was taken.

2. The learned counsel for the present trustee submits that she represents the present trustee. She admits that as per the scheme, the trustees are appointed and she has got no objection on the appointment of the trustee as per the scheme. She further submits that Joint Commissioner, HR&CE Department is the competent authority to appoint the trustee but the petitioner sent representation to the Commissioner, HR&CE Department.

The learned Government Advocate for the respondent submits that by considering the petitioner's representation, dated 27.06.2022, the trustee to be appointed as per the scheme within a period of three months. He further submitted that the petitioner to sent a representation to the Joint Commissioner, HR&CE Department, Madurai so that the scheme can be implemented.

Considering the submission and on perusal of the materials, the petitioner is directed to submit a copy of his representation, dated 27.06.2022 to the Joint Commissioner, HR&CE Department, Madurai within a period of three weeks from the date of receipt of copy of this order. Thereafter, the Joint 2/4

Commissioner, HR&CE Department, Madurai is directed to appoint a trustee to the trust as per the scheme within a period of three months thereafter.

5. With the above direction, the writ petition stands disposed of. No costs.
