Crime No.3/2003 : Respondents PRAYER: Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents to withdraw and revoke the Lookout Circular Notice issued to the immigration authorities through the 2nd respondent against the petitioner in Crime No.3 of 2003 on the file of the third respondent Police forthwith.

ORDER

The petitioner has filed this writ petition seeking a direction to the respondents to withdraw and revoke the lookout circular issued as against the petitioner in connection with the case in Crime No.3 of 2003.

2. Learned Counsel appearing for the petitioner submitted that the petitioner is arrayed as an accused in Crime No.3 of 2003 and since the petitioner was in abroad, a final report has been filed as if the petitioner is absconding. The petitioner was also declared as a proclaimed offender and a lookout circular was also issued. https://hcservices.ecourts.gov.in/hcservices/ 1/2

WP(MD)No.22036 of 2016 Therefore, the petitioner has filed this writ petition.

3. Learned Additional Public Prosecutor, on instructions, submitted that subsequent to the lookout notice, the petitioner was arrested, when he returned to India. He was produced before the concerned Magistrate and the Magistrate has also enlarged him on bail. Therefore, nothing survives for further adjudication in this writ petition.

4. In view of the submission made by the learned Additional Public Prosecutor that the petitioner was apprehended by the police at the time of his landing in India and thereafter, enlarged on bail by the concerned Magistrate, this Court is of the opinion that the prayer sought for in this writ petition has become infructuous. Once the petitioner was apprehended and thereafter, enlarged on bail, the lookout notice issued itself has become infructuous.

5. In the result, this writ petition stands dismissed as infructuous. No costs. Pending miscellaneous petitions, if any, shall stand closed.
