This petition has been filed for a direction to the first respondent to transfer the investigation of the case in Crime No.4 of 2023 pending on the file of the fourth respondent to the file of the third respondent and to club all the other pending cases against the petitioner and the company which are pending on the file of respondents 5 to 7. 2/7
2.The grievance of the petitioner is that multiple complaints are being filed before various jurisdictional police station and as a result, multiple FIRs have been registered. In view of the same, the petitioner wants to club all the cases which could be investigated by one Agency. In view of the same, the petitioner made a representation to the first respondent. Since the same was not considered, the present writ petition has been filed before this Court.
3.When the matter was taken up for hearing, the learned Government Advocate submitted that the Inspector General of Police, Central Zone, Trichy, has already addressed a communication to the Director General of Police to transfer all the cases to the Economic Offences Wing, Chennai, for further investigation. Pursuant to the said communication, the Director General of Police, through proceedings dated 26.10.2023, has directed the Additional Director General of Police, Economic Offences Wing, Chennai, to nominate an Investigating Officer to take up further investigation in all the connected cases. 3/7
4.The learned Government Advocate, on instructions, submitted that the Additional Director General of Police, Economic Offences Wing, Chennai, is yet to nominate an Investigating Officer to take up further investigation. It was submitted that once such an Officer is nominated, all the connected cases will be clubbed and it will be investigated by the same Officer.
5.In the light of the development, the grievance expressed by the petitioner has been redressed. There shall be a direction to the Additional Director General of Police, Economic Offences Wing, Chennai, to immediately act upon the proceedings of the Director General of Police, dated 26.10.2023 and to nominate an Investigating Officer to take up further investigation. While doing so, all the cases shall be clubbed together to ensure that multiple Investigating Officers do not conduct the investigation. The necessary proceedings shall be issued by the Additional Director General of Police, Economic Offences Wing, Chennai, within a period of four weeks from the date of receipt of a copy of this order.
