PETITION FOR BAIL Under Sec.483 of B.N.S.S.

PRAYER :- For Bail in Cr No.9 of 2024 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 23.03.2024 for the offence punishable under Section 376(A)(B) IPC and Sections 5(m) (n)(1) and 6 POCSO Act in Crime No.9 of 2024 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the defacto complainant's daughter is 1/3

studying 4th standard and she used to stay the petitioner's house, who is her relative. The petitioner misbehaved with the defacto complainant's daughter. Hence, the case. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 23.03.2024, hence he may be released on bail.

4.The learned Additional Public Prosecutor vehemently opposed to grant bail to the petitioner on the ground that in the statement of the victim girl recorded under Section 164(5) Cr.P.C., she has stated the manner in which the petitioner misbehaved with her.

5.This Court perused the statement of the victim girl recorded under Section 164(5) Cr.P.C. Considering the gravity and seriousness of the offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner.
