For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.Not Known of 2023 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 417 of IPC and Section 4 of Tamilnadu Prohibition of Harassment of Women Act, 2002, in Crime No.Not known, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is there was a love affairs between the petitioner and the defacto complainant. But, later the defacto complainant came to know that the petitioner had marriage engagement with some other girl. Therefore, the defacto complainant lodged complaint before the respondent police, as if she was cheated by the petitioner.

3.The learned counsel for the petitioner would submit that the petitioner is innocent person.

CRL OP(MD). No.12077 of 2023 The learned Government Advocate (Crl. Side) would submit that so far no case has been registered against the petitioner. Only enquiry is undertaken in C.S.R.No.329 of 2023, which is also pending.

4.Reading of the complaint shows that this petitioner was in love affair with the above said defacto complainant for about five years. Later, this petitioner wanted to break the above said relationship. On that ground the above said complaint was given. 5.The learned counsel for the petitioner would submit that even though they were in love affair for some time, the defacto complainant was about to marry some other boy on the arrangement made by her parents.

6.Let the above said complaint be enquired by the respondent police, by summoning the petitioner as well as the defacto complainant and dispose of the same within a period of one week from the date of appearance of parties. Depending upon the outcome of the enquiry, if any necessity arises the petitioner can workout his remedy through appropriate proceedings.

7.With the above said directions, this criminal original petition stands dismissed.
