O R D E R
This criminal original petition has been filed seeking a direction against the 1st respondent to transfer the investigation in Crime No.110 of 2024 dated 14.07.2024 on the file of the 3rd respondent to the 2nd respondent and to file a final report.
2.The learned Government Advocate (Crl. Side) submits that the case was registered only on 14.07.2024. It is a case and counter case. Both the cases are in the initial stage of investigation. 3.The learned Counsel for the petitioner by referring to the photographs of the victim submits that the victim has sustained serious head injury. Despite the same, the respondent police has registered the 2/4
case only for the offence under Section 324 of IPC. Further, he submits that the third respondent in order to help the accused has foisted a false complaint as against the petitioner herein as a counter complaint. 4.This Court considered the rival submissions made. 5.The investigation is in the initial stage and therefore, this Court is not inclined to transfer the investigation. The respondent police is having a duty to conduct the investigation in a fair and proper manner. 6.Accordingly, this Criminal Original Petition is disposed of with a direction to the third respondent to conduct the investigation in a fair and proper manner.
