Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus directing the respondents to dispose of the petitioner's objection petition, dated 29.09.2016 and appeal dated 07.02.2016 within a time frame as fixed by this Honble Court after affording all opportunities to either parties concerned in the manner known to law.

ORDER

Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

2. By consent, the Writ Petition itself is taken up for final disposal.

3. Even though the petitioner makes two prayers in this Writ Petition seeking a direction to the respondents to dispose of the petitioner's objection petition, dated 29.09.2016 and appeal dated 07.02.2016, the learned counsel for the petitioner restricts the prayer only to dispose of the appeal pending before the first respondent.

4. According to the petitioner, against the order passed by the Tahsildar transferring patta in favour of one Rathinavel, he

filed an appeal before the first respondent on 07.02.2016 and the same is pending before the first respondent without any disposal.

5. In the above circumstances, without going into the merits of the case, the first respondent is directed to consider the petitioner's appeal, dated 07.02.2016 and pass suitable orders on the same, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order, after giving notice to the petitioner as well as rival claimants if any.

With the above direction, this Writ Petition is disposed of. No Costs.
